These terms and conditions of use ("Terms") govern your use of the FLICK application, published by [À COMPLÉTER — dénomination du responsable de traitement] ([À COMPLÉTER — forme juridique]), [À COMPLÉTER — adresse postale]. By creating an account, you accept these Terms as well as the Privacy Policy. The processing of data revealing your sexual orientation is subject to a separate consent, collected separately during registration.
1. Purpose
FLICK is a dating and messaging application intended for the LGBTQ+ community, offering proximity-based profile discovery, end-to-end encrypted messaging, and community spaces.
2. Eligibility — 18 years minimum
FLICK is strictly reserved for persons who are adults (18 and over) and legally capable. Declaring an incorrect age constitutes a breach of these Terms and results in the deletion of the account. Any account detected as belonging to a minor is deleted without notice, and any contact by an adult seeking to enter into a relationship with a minor is reported to the competent authorities.
3. Your account
- One account per person only, for personal and non-commercial use.
- You are responsible for the confidentiality of your credentials and for the activity on your account.
- As your conversations are end-to-end encrypted, the loss of your device or your password may result in the permanent loss of your message history: we are technically unable to restore it.
4. The service
- FLICK is in the development phase: the service is provided "as is", may evolve, be interrupted or limited (features enabled or disabled) without this giving rise to any right to compensation, within the limits permitted by applicable law.
- The messaging is end-to-end encrypted (Signal protocol): we do not have access to the content of your conversations.
- Proximity-based discovery relies on a deliberately degraded location (see the Privacy Policy).
5. Your content
- You remain the owner of the content you publish (profile photos, biography, posts, comments).
- You grant us a worldwide, non-exclusive and royalty-free licence, limited to what is strictly necessary to operate the service (to host, transmit, display to other users, and moderate your content). This licence ends when the content or the account is deleted, subject to the technical time frames described in the Privacy Policy.
- You warrant that you hold the necessary rights to the content you publish. In particular, do not publish the image of another person without their consent.
6. Rules of conduct
The following are prohibited, across all surfaces of the service (profile, photos, communities, and messages insofar as they are reported to us by their recipients):
- Any illegal content or behaviour; any involvement of minors, including presenting oneself as a minor or soliciting a minor.
- Sexually explicit content on public surfaces (profile photos, public communities) — a detection filter runs on your device and may block such a publication.
- Harassment, threats, disclosure of another person's personal data ("doxxing"), hate speech (in particular LGBT-phobia, racism, serophobia), incitement to violence or self-harm.
- Identity impersonation, fake profiles, romance or financial scams, spam, unauthorised commercial solicitation, prostitution or any financial consideration.
- The non-consensual sharing of intimate images, the recording or capture of another person's content with a view to distributing it.
- Technical attacks: automated data extraction ("scraping"), attempts to de-anonymise or precisely locate another person (including by triangulation), circumvention of security measures, unauthorised automation.
- The circumvention of a sanction (for example, creating a new account after a ban).
7. Moderation (information under Article 14 of the Digital Services Act — DSA)
- Tools available to you: one-tap reporting of posts, comments, profiles and media; blocking a user, which prevents any contact and makes you mutually invisible; a nudity filter run locally on your device; rate limiting against abuse.
- How moderation works: reports within communities are weighted by the reporter's historical reliability; beyond a threshold, the content concerned is removed and its author may be temporarily silenced ("muted") or banned from the community, according to a points scale. Community moderators and our team may also act manually. Media subject to a large number of reports is removed automatically.
- Protection against triangulation: accounts whose declared movements are physically impossible have their location accuracy temporarily degraded, in order to protect other users.
- Notice and appeal: when one of your pieces of content is removed or your account is sanctioned, you are informed and may contest the decision by writing to [À COMPLÉTER — e-mail de support]. We examine appeals diligently and in a non-arbitrary manner.
- Reporting illegal content (Article 16 of the DSA): any person, whether a user or not, may notify us of content they consider illegal by writing to [À COMPLÉTER — e-mail de support], specifying the location of the content and the reasons for its illegality.
- The detailed rules of community life are set out in the "Community Rules" document.
8. Account deletion and termination
- By you: at any time, in Settings → Account → Delete my account (the effects are described in the Privacy Policy), or by email.
- By us: in the event of a serious or repeated breach of these Terms, of an account belonging to a minor, of a legal requirement, or of the closure of the service (in the latter case with reasonable notice). The reasons are communicated to you, save where legally prohibited or where there is a risk to safety.
9. Liability
- FLICK connects adults; we do not verify users' identities. Exercise caution when meeting: favour public places and inform someone close to you. We are not responsible for users' conduct outside the service.
- Within the limits permitted by applicable law, our liability is limited to direct and proven damages resulting from a fault attributable to us. Nothing in these Terms excludes liability that cannot lawfully be excluded (in particular in the event of wilful misconduct, gross negligence or personal injury).
10. Intellectual property
The application, its trademarks, its design and its code remain our property or that of our licensors. You are granted a personal, non-exclusive, non-transferable and revocable licence of use.
11. Amendment of these Terms
We may amend these Terms. Any substantial change is notified to you within the application at least 15 days before it takes effect. Continued use constitutes acceptance; failing this, you may delete your account.
12. Governing law and disputes
These Terms are governed by [À COMPLÉTER — droit applicable], without depriving you of the mandatory protections afforded to you as a consumer by the law of your country of residence. In the event of a dispute, the competent courts are [À COMPLÉTER — juridiction compétente], subject to applicable mandatory rules.
